The following T&Cs shall govern the terms under which you may use the services of Circlepay.ph, By registering to Circlepay.ph or using services of Circlepay.ph, you accept and agree to be legally bound by the T&Cs. These T&Cs shall be effective, valid and binding from the time you agreed to it and will exist up to the time that it is terminated by you or us, save for those provisions that will remain effective after termination as stated in these T&Cs, laws or regulations. Circlepay.ph reserves the right to modify these T&Cs at any time without any advance notice. Any changes to these T&Cs will be effective immediately upon posting on this page, with an updated effective date. By accessing or using the Circlepay.ph Service after any changes have been made, you signify your agreement on a prospective basis to the modified T&Cs and all the changes. Be sure to turn to this page periodically to ensure familiarity with most current version of the T&Cs. Under these T&Cs, the terms “Circlepay.ph”, “we”, “us”, and “our” refer to Circlepay.ph together with its employees, directors, affiliates, successor and assigns. 1. BASIC TERMS 1.1 By accepting the T&Cs, you represent that you are at least 18 years old to register for a Circlepay.ph account. If you are younger than 18, parental consent will be required of you. 1.2 If you are a business entity, you also represent that you are duly authorized to do business and your employees, officers, representative and other agents accessing. 2. DEFINITIONS Definitions appearing in these T&Cs shall have the meanings ascribed to them below. “Circlepay.ph” shall refer to a form of payment gateway which allows customers who registered to Circlepay.ph easily and conveniently use different methods of payment. “MOMO Wallet” shall refer to e-money instrument that stores Vietnam Đồng (VND) value which resides in the MOMO system. “Internet Banking” shall refer to instant fully automated online banking system. “Circlepay.ph Customer” shall refer to a person who registers for our service. “Circlepay.ph partner” shall refer to establishment that accepts Circlepay.ph as payment gateway to sell goods and services. 3. TRANSACTION AND LIMIT Transaction and balance limits may be assigned or changed by circlepay.ph, at its option pursuant to applicable laws, subject to fifteen (15) days prior notice to the circlepay.ph Customers. 4. LOYALTY / REWARDS PROGRAM 5. FEES, RATES AND OTHER CHARGES Circlepay.ph partners shall pay a fee for any transaction happens thru Circlepay.ph where fee is required. Circlepay.ph Customer agrees to pay other fees and charges related to his/ her transactions. 6. PHONE AND Circlepay WALLET 7. TERMINATION / CANCELLATION OF THE Circlepay.ph services Should the Circlepay.ph Customer fail to comply with the Terms and Conditions provided herein, the right to use the Circlepay.ph services shall be terminated. 8. FRAUDULENT TRANSACTIONS Blocked Circlepay.ph user – Circlepay.ph shall have the right to automatically suspend or block the Circlepay.ph user in the event that Circlepay.ph has reason to believe that the Circlepay.ph Customer’s Circlepay.ph may be used for fraudulent or suspicious transactions or by an unauthorized person. Circlepay.ph may but shall not have the obligation to inform the Customer prior to suspending or blocking user ID. 9. DATA PRIVACY 9.1 Data Collection Circlepay.ph shall keep all your files confidence. By providing your information, you expressly consent to the processing of your supplied customer data, as may be applicable. Your customer data is either Personal Information or Non-Personal Information: a. Circlepay.ph collects no personal information from the users. Personal Information is any information from which your identity can be reasonably and directly ascertained, or when put together with other information would directly and certainly identify you as an individual. It also includes, but not limited to, data that would help us verify Your name, gender, date of birth, address, telephone/mobile number, proof of identification, source of income, employment, and other data points whenever applicable; b. Non-Personal Information is any information that does not identify Circlepay.ph Customer individually, and includes transactional, statistical, and analytical data, and anonymous and aggregate reports. 10. SEPARABILITY CLAUSE Should any term or condition in this Agreement be rendered void, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining terms and conditions shall not be affected or impaired thereby. 11. AGREEMENT The Circlepay.ph Customer agrees to be bound by the Terms and Conditions governing the issuance and use of the services. 12. CUSTOMER COMPLAINTS HANDLING PROCESS We are committed to maintaining the highest standards of financial consumer protection. Your requests, feedback and customer needs are our priority.
